ORDERING AND SHIPMENT OF AN ARAGÃO COLLECTION PRODUCT
By selecting Empório Aragão product you are not obligated to order. Products you wish to revisit later to order may be saved in your User account shopping cart. However, any products not ordered and instead saved in your shopping cart may be removed and/or deleted by Empório Aragão at any time, at its sole discretion. Empório Aragão bears no responsibility for any damages or losses attributed to the cancelation or removal of a Product from shopping cart that you have not ordered.

By placing an order through the Empório Aragão Platform, it will be considered that you have made a binding offer for the purchase of the particular product. In order to make such a purchase you will be required to submit payment information, which may include, without limitation: credit card information, debit card information, shipping address, billing address, full name and any other information Empório Aragão believe to be necessary to ensure all information necessary to ensure complete, accepted and processed payment for and shipment of the Product are proper.

Upon order of a Product and a complete transaction, you will be sent a confirmation email. This confirmation email is not an acceptance of your offer, but instead acknowledges Empório Aragão receipt of your order.

The Empório Aragão collection is a limited-edition created exclusively for you from the date of purchase, whereby we cannot guarantee the availability of a particular product you have ordered, despite your ability to submit an order. In the event an order has been submitted and paid for that is not available at the time of order, your Product will be placed on back-order until such time your order can be fulfilled. Printed, cut and handmade with upmost high quality and accuracy, all Aragão collection sales to you are final as set forth in Section Returns and All purchases final of this Agreement.

Once your order is processed through our Platform and accepted by us for creation, you will receive an additional email informing you of the timeline in which your ordered Product will be ready for shipment (“Order Approval”). Depending on the complexity of the design selected and the amount of orders being processed, Empório Aragão may delay the creation and shipment of your ordered Product, in which case Empório Aragão will notify you of such delays and expected completion and shipment dates, respectively. We may include API tracking capabilities dependent on the type of shipment method. All products from Aragão collection include free international standard shipping (5-20 business days after processing). You may be provided with various options to ship your ordered Product. Empório Aragão bears no responsibility for any and all shipping carrier’s inability to ship your ordered Product. Further, Empório Aragão may, in its sole discretion, select a different shipping carrier on your behalf. You will bear the cost of any shipping costs and fees associated with your selected method of shipment or shipping carrier. Empório Aargão are not responsible for any miscalculations associated with any shipment method’s shipment timeline, whether provided to you through the use of such API tracking capabilities by Empório Aragão or any other means (including, but not limited to emails sent to you by Empório Aragão regarding your shipment timeline).


Empório Aragão cannot guarantee the adherence to any timeline and any timeline provided in any Order Approval is an estimation of the time it will take to complete and ship your ordered Product. We bears no responsibility for any damages or losses suffered as a result of the arrival or delay of arrival of your ordered Product.

Empório Aragão reserves the right, in its sole discretion, to reject any order for any reason at any time without advance notice to you.

Title to any Product on the Empório Aragão Platform shall remain with Empório Aaragão until payment for such Product has been received and the Product has been placed with the shipping carrier. Thereafter, title and risk of loss for all Products ordered by you will pass to you, upon receipt of full payment and your ordered Product to the shipping carrier.

If the order has already been shipped it is your responsibility to contact the carrier to make necessary address updates (if applicable). Economy/Standard packages will not be able to change the address once it’s submitted. If the package is not able to be delivered successfully due to an address error, the customer may contact the carrier to arrange for delivery. Otherwise, the customer may risk the package being destroyed by the carrier. If the carrier will not take possession of the package due to incorrect or incomplete address, Empório Aragão will attempt to notify the customer via email. Customers have 14 days from the date of notification to respond with a verified address, additional fees may incur which will be due in advanced of reshipment. If no response is received within 14 days, Empório Aaragão reserves the right to donate the merchandise and the order will not qualify for a refund. Refunds for the cost of shipping will only be given in the event the entire order qualifies for a refund as defined by our Empório Aragão Undelivered Package Policy.

Shipments may encounter custom duty fees. The fees are based on the destination and the regulations the country being shipped to. Different countries have import procedures which is determined by its custom’s law in the destination country, not Empório Aragão or the carrier.

Typically, the type of goods shipped and the value of that good are factors determining custom duties and taxes. Ultimately, the end customer will be responsible for paying the customs duty.

RETURNS
In the event your product is damaged or defective, please submit a Return Form within fourteen (14) days of delivery of the damaged or defective product and you must provide reasonable proof to us of such damage or defect. We will promptly review your correspondence in order to determine whether such damage or defect warrants a refund. Empório Aragão will inform you of its decision to approve or deny your request with an explanation of its decision in accordance with our Guarantee Policy.

Should the return be considered a defect, Empório Aragão reserves the right to investigate and conduct a thorough analysis of the defect, which may include sending the defective merchandise to Empório Aragão before a decision can be made. For defective products, Empório Aragão will offer a pre-paid shipping label and the merchandise must be shipped within seven (7) days of the issued pre-paid label date. Failure to send back the merchandise within seven (7) days of receiving the shipping label will disqualify the order from the review process and a refund will not be issued. Empório Aragão will not honor defect requests which are attributed to customers size concerns or design, such as plastic characteristics of the represented artwork. Our in-house Customer Experience team is fully equipped to process your return request quickly and efficiently so you spend less time waiting, and more time happy.

In the event your product is damaged or defective, please send us an email to emporioaragao@gmail.com, intitled “Return Request” within fourteen (14) days of delivery of the damaged or defective product and you must provide reasonable proof to us of such damage or defect. Empório Aragão will promptly review your correspondence in order to determine whether such damage or defect warrants a refund. We will inform you of its decision to approve or deny your request with an explanation of its decision. For returns including defect requests, Empório Aragão communicate with the customers on shipping instructions should they want the return product sent to Empório Aragão Textil Partner fulfillment center. After 30 days, the returned product will then become Empório Aragão property for donation. Should any of the information listed above be incomplete or inaccurate, the return processing will be delayed.



Before submitting for a return, please note the following:
– Packaging and product returning must be in original form. Dirty or worn clothing with missing tags/labels are not eligible. Washed clothing is not eligible for return.
– Review our sizing charts before orders are placed to ensure our sizing meets your product requirements for your customers.
ALL PURCHASES FINAL
Due to the artistic limited-edition nature of the Products you have ordered, all printed, cut and handmade exclusively for you, no cancellations are accepted after an order has been submitted. Your order shall be non-refundable and final. You acknowledge and agree that ordered Products produced by us for you are custom goods. In any scenario other than where a Product is defective or damaged pursuant to Section Returns of this Agreement, you have no right to cancel any order or return any Products and all orders, once accepted by Empório Aragão, are final.
UNDELIVERED PACKAGES
If your package has not been received, Carriers will determine the package as ‘Undeliverable’ or ‘Lost in Transit’. If you have not received your package within the allotted time below, you may call the Carrier directly as the customer or notify Empório Aragão to investigate. If the Carrier lost the package in transit, we will file a claim on your behalf and issue a full-refund. Empório Aragão will not be able to refund orders if outside the policy dates below and reserve the right for an investigation period:
– Express/Premium- please notify within 14 days of the ship date.

The following exceptions apply:
– We are not able to file claims on packages marked as delivered by the Carrier. If your order is marked as delivered by the Carrier, and you do not have the package, please reach out to the carrier directly to file a claim. No refunds will be issued for orders marked as delivered. Delivery times include observed holidays or unexpected carrier delays.
– Errors caused by customer’s incomplete or insufficient address, Empório Aragão will not be able to refund orders. Packages are never guaranteed to be rerouted to Empório Aragão and may be disposed by the carrier which Empório Aragão are not at fault for.
US territories or an APO address shipping can range from 15-35 days or longer in some cases. Please contact emporioaragao@gmail.com for status after 40 days. All Aragão Orders placed with Standard shipping.

We further inform you that, due to customs restrictions, the estimated delivery time may be longer than estimated to the Crimea, Lugansk and Donetsk regions in Ukraine, Russia, Belarus, Ecuador, Cuba, Iran, Syria and North Korea.

Empório Aragão reserves the right, without further notice to you, to modify the Aragão collection terms and conditions. By agreeing to these terms, you confirm that you are over the age of 18 or have given your consent to allow any of your minor dependents to use this website. When using the platform, interacting with it and making or not a purchase, you are automatically accepting our terms and conditions. If you do not agree with all the Terms and Conditions, Privacy Policy or Refund Policy please do not access the website or use our services.
